SATURDAY, MAY 11, 1878 WHAT THE NATIVE LAND COURT IS, AND WHAT THE NATIVE TRIBES OF NEW ZEALAND WANT. IN our present issue we give a report of the proceed- ings of the Native Laud Court, held in Napier, as staged by the Judge presiding at the Court," To ascertain, by order of the Supreme Court, what share each of the grantees was entitled to in the Block Mangateretere West, and not for the sub-dividing of the land." At a subsequent adjourned sitting on the 1st of May the same Judge stated, " that, the case was purely one of genealogy, and if it could not be settled in two days, it never would be settled, and it would be useless appointing the Court again." We are not surprised that such language should proceed from the lips of those who are the present Judges of the Native Land Court, as it is one more proof of the truth of our past assertions in regard to the efficiency of the officers appointed to administer justice to the Native owners in regard to Maori hereditary claims to Iand. The Native Lands Act, or that law, what- ever it may be, which constitutes a Native Land Court, and through which the Maori is to obtain a Crown title for his land, is one of the most important laws which the New Zealand Par- liament has brought or can bring into force, and the most searching enquiry should be made before the various items which constitute the law are passed by the Assembly. We look upon the passing of the present Native Land Court Act as one of the greatest mistakes which the Assembly of New Zealand has ever made. And to show the uncer- tainty which existed in the minds of those who framed this Act at the time when it was being the subject of inquiry, and the doubts felt by those who took part in framing the draft of that Act, we quote from the Governor, Colonel T. Gore Brown, who, in a letter dated 6th May, 1861, written to the Chief Justice and the Judges of the Supreme Court, asks, " First, whether the constitution and mode of procedure of the Supreme Court can be adopted for the investigation and determination of questions relating to Maori title. If this question should be answered in the negative, secondly, whether an efficient Court could be established for such pur- pose, and what should be the nature of its constitu- tion and procedure." The Chief Justice Sir G. A. Arney, Judge A. J. Johnston, and Judge H. B. Gresson answered:— " But treating the matter in the largest and most general way, we feel justified in suggesting that a competent tribunal might probably be established by the formation of a Land Jury, selected by lot or otherwise, from members of the various tribes in pre- viously defined districts, nominated by such tribe as competent to act in that capacity, to be presided over by an European officer or Commissioner (not being an agent of the Crown for the purchase of land) conversant with, the Maori language, and assisted, if necessary, by a Native Assessor, and whose duty it should be merely to propound the question for the decision of the jury, to record their verdict, and to administer oaths to witnesses." Again the same Governor, Colonel T. Gore Brown, states in a memorandum dated 25th May, 1861, re- ferring to the opinion of the Judges given above :— " They have not entered upon details, but it occurs to me that a judicial officer (query a Judge) residing in Auckland should have power to issue a commission enabling the holder to associate two Native Assessors with himself, and then to empanel a jury, as advised by the Judges. I am inclined to think that the decision of a Commissioner, with disinterested Native Assessors, would be safer and more likely to decide impartially than a Maori jury; but I hesitate to advise anything not exactly in accordance with the opinion of the Judges. Such Court, however con- stituted, would be powerless unless both parties consented to abide by its decrees." The quotations above given show the starting point from which the present Native Land Court derived its origin. But there must have been counter plots behind the scenes, such as arise from desire for personal power, honour and wealth. These delicious draughts to the longing lips of proud aspirants, in this case cast a baneful blight on the Native Laud Court. This power and the object is seen in the words above given, viz. : " I am inclined to think that the decision of a Commissioner with. disinterested Native Assessors would be safer and more likely to decide impartially than a Maori jury." The signal failure of the Native Land Court may be traced to this opinion, which, though given, by the then Governor, was not derived from his own knowledge, as he knew little or nothing of the Maori customs, but

TE WANANGA. from some one who was a seeker of power, with the most superficial knowledge of Maori customs and their laws, and even less knowledge of the Maori people. This person evidently longed for place and name, no matter at what cost or sorrow to the Maori or expense to the public purse. Indeed, selfish- ness alone must have been his prompter in this instance. As yet the remedy is not difficult. Do away with the Native Land Court as at pre- sent constituted, and constitute a Court consisting solely of Maori chiefs, who are to do their work gratis appoint a European clerk, who understands the ] Maori language, to assist in administering the oaths 1 in the Court, and to write the evidence and record | the decisions of the Court, and let the salary of such. : clerk be paid by those whose lauds are dealt I with by the Court. Such a Court will not be any cost to the country, and will give satisfaction to the Native land owners. When the present Native Land Court was spoken of, one who is now in power J in ihe Government stated that the Native Land I Court, if instituted, would add to the revenue of the I colony, but the opposite has been the case. It has cost more than the worth of the good it has done, and its acts and doings will be the field in which, a plentiful harvest will be reaped by future lawyers. I If wo regard what the present Native Land Court has accomplished, we shall see what we are to expect from it in future. In most cases it has only said that certain lands belong to the Maori. We all know this, without the costly investigations of the Native Land Court. It has given the names of ten Maoris on a piece of parchment, which. Maoris are called the owners of the land so delineated on parchment. These Maoris, in more than oue instance led away by the ambiguous language of the Court, have sold the land for which they were not clearly defined, though legally intended to be, the guardians and trustees for their people. The Native Land Court has not been able iu any instance to give individual grants to claimants. Then, we ask, in all that is called common sense, what has this Court done? or what can it do ? The answer is, that the Maori claims to land were all in confusion so far as the European knowledge of the matter was concerned. But this Native Land Court has made confusion more confounded, and caused a vast and useless expense to the colony, and sown the seed of a terrible harvest of litigation. Esq., Judge, and Hoani Taipua, Assessor.) The Court was opened at 11 o'clock. THE MANGATERETERE BLOCK. The Judge explained to the Natives present that the enquiry was brought on by order of the Supreme Court to ascertain what share each of the grantees was entitled to in the block, Mangateretere West, and not for the purpose of sub-dividing; the land. Paora Torotoro, one of the grantees applied on behalf of parties interested for un adjournment, on the ground that Tareha Te Moananui, one of the principal men inter- ested, was very ill, and would be unable to attend. His Honor granted the application, and the Court was accordingly adjourned to Tuesday, April 23. TUESDAY, APRIL 23. The Court was opened at noon. THE MANGATERETERE BLOCK. Mr. Rees appeared, and was about to address the Court, when ; His Honor said that he was precluded by the Act from hearing counsel or agent. Of course he would be happy i to hear anything Mr. Rees had to say, but not in the i capacity of counsel representing the parties in the matter before the Court. Mr Rees thought it was in the discretion of his Honor to allow counsel to appear. i His Honor said the Act was imperative on the point, and gave him no discretion. He must hear the parties personally ; they could not appear by counsel or agent. Mr. Rees said that he merely wished to inform the Court i that the parties concerned in the case now under enquiry wanted an adjournment, so that the matter might be re- ! ferred to five chiefs who had been appointed to take evidence and to make a report to the Court. Hoani Taipua (the Assessor) had been asked to be one of the i tive, but he had declined. The names of the chiefs were i Manihera, Wiremu Mahupuku, Hori Te Huki—all three of Wairarapa—Hoani Meihana, of Rangitane, and Wi Pere, of Gisborne. With regard to any European interests that might be affected, such interests were already defined, J and had accrued previous to the passing of the Act of
