(Continued from our last.) i After those lands had gone through the Court they became subject to leases to Europeans, who, in most i cases, paid small rent, because the ground being un- improved, a large expenditure of capital was required before it would bring in a return, sufficient to pay the lease ; yet in nearly every one of these leases there was inserted a most remarkable covenant, a covenant which the best lawyers have pronounced to be nothing more or less than confiscation of the land, because, in a general way, it rendered the land comprised in the lease liable for all the improvements, ploughing, fencing, and so on, which might be effected by the leaseholder during the term of his lease. That, I say, is confiscation, and I am satisfied that in the great majority of cases the Natives who entered into these leases had no idea of the full extent and significance of this covenant. It was a sort of set doctrine in the Province, that those who acquired the lease from the Natives had, as between themselves and other Euro- peans, a moral right to the freehold: and anyone who stepped in and attempted to acquire the freehold was looked upon as an interviewer and a dishonest person. From the very first, the lease was supposed to have the way to the freehold. In many cases the rent was delayed or withheld and in those instances the Natives had recourse to the storekeepers and the hotelkeepers, and contracted debts which were in a very short time followed up by a mortgage, and subsequently by a conveyance. I will give the House some idea of the way in which operations were conducted against a particular block of land. It is not a solitary case. It is a general case, and will illustrate the way in which these properties change hands. The land having been let under a lease having this clause in it, and the Natives hav- ing been kept out of their rent, the next step was to place an outpost in the neighborhood of the property, in the shape of a public-house and store together. There the Natives go for their stores and liquor; goods of inferior quality were sold to them for the highest prices, and, as a rule, the liquor was of such a quality that to have survived its consumption in large quan- tities was the best possible testimony to the physical stamina of the Natives of Hawke's Bay. That did not go on long before the debt was found to amount to a considerable sum, and then application was made to the Natives to give a mortgage. I have said that these Natives are an ignorant people ; and I can assure the House that I went to Hawke's Bay in 1873, and having the best possible desire to enter fairly into the merits of these cases, I found that the Natives had not the least idea of the significance of the term " mort- gage." They had no thought that to give a mortgage was to part with the legal estate absolutely. It must not be supposed that the leases knew nothing of these things, because in the great majority of cases it was done with the consent of the lessees, who, after the mortgage had gone on a little time, stopped in and took over the land, and gave the publican or the store- keeper a bonus upon his money. The result was that from the time any large quantity of land became subject to the Crown grants in Hawke's Bay, till some three years ago, the Natives of that province wero given up to, what I may call, one continuous " drunk." The supplies of liquor and goods came so freely to the storekeepers, who were protected by these mortgages, that they could afford to give credit until the land that was to form payment for all these things had slipped through, the hands of the Natives. This state of things went on, as I have said, from 18G7 or 1868 Until about 1872. Estate after estate of the most valuable character was got hold of by means of goods, by means of liquor, and by moans of advances covered by the mortgage, until at last the grantees were driven into a corner, and were compelled to sign a conveyance ; and thus the land was parted with, the interests of a large body of outsiders being completely ignored. No one knows better than yourself, Sir, that in the great ma- jority of cases a grant which purports to be a grant to A, B, or C, cannot be presumed to be a grant to those persons only. The Natives named in a grant are re- garded as representative people. There were behind each a large number of others who claimed, but they were shut out, because no more than ten names ap- peared in the grant. The Court did not take the trouble to put the name of each claimant in the grant; and tans by the operation of the law, the improvidence of the Natives, and the guilty conduct of designing persons, the great bulk of the land passed away into the hands of the Europeans. I am not one of those who contend that the Natives should be allowed to remain in possession of immense freehold estates. I have always held that they should be allowed to divest themselves of it, retaining sufficient for their own purposes to prevent them becoming a burden upon the colony ; | but every honest inati would like to see that process carried ou in a manner fair and above board, and not, as some of these transactions were conducted, by means of rum, misrepresentation, and the employment of people of absolutely improper, and, I may say, dis- honorable character. T wish to guard myself against any misapprehension by saying that I do not bring these charges against the people of Hawke's Bay as a body. There are but very few people in Hawke's Bay who stand connected with these matters. The great bulk of the population were silent, and I believe, could they speak their minds, we should find that they were sorrowing spectators of what was going on. It was only the "ring" who moved in these transactions, and had the opportunity of carrying them into effect. Only about twenty five or thirty people were concerned in them ; and it was rather curious to find, upon searching the records of the Native Land Court of Hawke's Bay, that, out of eighty or ninety charges made, eighty-five of those charges were made against some one or other of these twenty-five or thirty people. So that the whole mischief—for mischief it is—has been done by these few people. To show how the operation of acquiring the freehold of land in that Province is carried on, I cannot do bettor than give a detailed case. It is a most interesting story, and will illustrate far better than any comments of (???) the point I am trying to bring under the notice of the House. Those who have been in the Province of

Te Wananga. Hawke's Bay are aware of the correctness of the state- ment that this land is of extraordinary value, and is situated in the immediate vicinity of the port. The great bulk of the land lying within twenty five miles of Napier belonged to the Natives, but most of it has now fallen into the hands of the Europeans. Before the Native Lands Act came into force in Hawke's Bay, one of the main topics discussed in the Provincial Councils and in the Press was the necessity of acquir- ing these lands as public estate, and there can be no doubt whatever that, in all honesty and fairness, they should have been acquired as public estate. Session after session of the Provincial Council the question was discussed. The Superintendents pledged them- selves from time to time that it should be so ; the members of different Executives pledged themselves that it should be so ; and yet we find in the end, after all these attempts on the part of the authorities to secure this land for the benefit of the colony, that the great bulk of it has passed into the. hands of a few people. I shall now give a case in point. What I may call the pick of the land to which I have been referring is known as the Heretaunga block. It con- tains about 19,000 acres. About 1,000 acres was shingle, and about 1.600 acres was set apart by the Natives themselves at the time of purchase by the Europeans, That land was put into the Native Land Court in 1867. Previous to that time it had been in the illegal occupation of certain Europeans. I ask the House to bear that in mind, because we hear a good deal about the illegal occupation of Native land ; but it had been in the occupation of certain Europeans, of whom the honorable member for Clive was one. I do not know whether the honorable member was Superintendent of the Province or a member of the Executive at the time : he was one or the other. One person in particular, upon whom the Natives in that Province relied for assistance and advice in their deal- ings with the Europeans, was a missionary named the Rev. Samuel Williams. He was instrumental in ne- gotiating a lease of an illegal character before the sitting of the Court. Subsequently he was instrumental in negotiating the legal lease, and afterwards was in- strumental in negotiating the sale of the lands of the Natives ; and all this time, while he was advising what would be the best for the Natives, he was secretly a party to the transaction himself. That statement was made on oath by that gentleman, in reply to questions put by me. He was not willing to answer the question at first, but on being pressed by the Commissioners he admitted that he was actually concerned in the trans- action—-that he made a bargain on behalf of the Natives from which he was secretly to benefit. That is the first of these transactions. The persons concerned in the lease were Mr. James Williams, the Missionary to whom I have referred, the Rev. Samuel Williams, Mr. Ormond (the honorable member for Clive), Mr. Thomas Tanner, Messrs. Russel, and a gentleman named Gordon. The granting of this illegal lease was the first opportunity for that practice, which stamps every one of these transactions with a stain. After negotiations had gone on for some time—I am saying this in the presence of the honorable member for Clive, and he (???) himself—for the terms had been arranged or partly arranged, a sum of £500 was paid to one of the grantees to induce him to sign the lease without the knowledge of the other grantees, and the lease was obtained. I shall not take up the time of the House by referring to the matter beyond this, that I believe the amount paid was largely below the value of the land, and the subsequent dealing with it confirms that opinion. After twelve months had elapsed, the first attempt was made to acquire that freehold. The House will bear in mind that, in the case of this par- ticular block of land, an assurance was given by the Native Land Court that no oue of the grantees should have power to sell, lease, or mortgage the land without the consent of the others. Well, after about a year, the first attempt was made to acquire the freehold; and it was acquired in this way : A Mr. Stuart had been up in Napier looking out for an investment. He saw this Heretaunga block, and found that it was iu the possession of certain Europeans. He was willing to buy up the right of reversion of the block, and he arranged with Messrs. Maney and Peacock to secure the land if they could, leaving a cheque for £1,500 as a sort of deposit to enable the transaction, to be gone on with. Maney and Peacock went to work in that fashion of which I have given the House an illustra- tion ; and it was found, on comparing notes, that they had a claim amounting to something like £1,200 or £1,300 against the chief Tareha, who was then a member of this House. They waited upon him, and told him he must pay up this cash. Of course he knew what the alternative was. If he did not pay the debt he must go to gaol, and that was an alternative to which one of the leading chiefs of the district was not inclined to submit in presence of his people. He assigned his tenth share of this block. Maney and Peacock then went to the holders of the lease, and said, " Look here : we have got a promise from Tareha to sell his share of the block for so much ; but he owes us so much. If you like you can take the land, and pay our debt." All this timo they were actually agents for another person, on whose behalf they had acquired Tareha's share, and whose money they had used in acquiring it.
