AN ACT TO MAKE BETTER PROVISION
FOR THE ADMINISTRATION OF JUS-
TICE IN NATIVE DISTRICTS.

VI. — CONSTABULARY.
XXXV. The Governor may from time to
time appoint Constables who within any
District appointed for the purposes of this
Act, shall have all the powers, privileges,
duties, and liabilities, which a Constable
hath, or is subject to, in New Zealand, and
elsewhere within the Colony, shall have the
like powers, privileges, duties, and lia-
bilities, so far as may be necessary for the
carrying into effect the provisions of this
Act; and who shall be removable at the
Governor's pleasure.
XXXVI. The Governor may from time
to time appoint Lock -up Houses within any
District appointed far the purposes of this
Act, with proper accommodation for the
temporary confinement of persons taken
into custody by any Constable or committed
for trial, and may from time to time abolish
any such Lock-up House.

XXXVII. Where the said Native Circuit
Court or any Resident Magistrate might
commit any person  to a Common Gaol,
such Court or Magistrate. may in lieu
thereof direct such person to be confined at
any such Lock -up House; Provided that
the  term of such confinement do not exceed
one week.
XXXVIII The Governor may from time
to time appoint keepers, to take charge of
such Lock -up Houses, and of the persons
there detained or confined; and such
keepers shall be removable  at the Governor's
pleasure.
XXXIX. The Governor in Council may
from time to time make and revoke regu-
lations prescribing the duties of such
keepers, and the treatment of persons
detained or confined at any such Lock -up
House, and otherwise respecting the man-
agement of such Houses; and by any such
regulations may impose penalties not ex-
ceeding five pounds for any breach thereof;
all which penalties shall be recoverable in
any Native Circuit Court, or in a summary
way by any Resident Magistrate specially
authorised by the Governor to hear the
case.
VII.—APPROPRIATION OF FEES AND FINES.
XL, All fees and fines received or levied
upon any proceeding in any Native Circuit
Court or Assessors Court held within a
District appointed under this Act shall be
accounted for quarterly to the Colonial
Treasurer, by the persons duly charged
with the receipt and custody thereof under
the authority of the Governor, and shall be
appropriated and disposed of from time to
time by the Governor in Council, for or
towards any of the purposes of Government,
Within such District. or otherwise for the
common benefit of the Inhabitants thereof.
VIll.—CONSTRUCTION OF TERMS AND SHORT
TITLE .
 XLI. For the purposes of this Act, Half-
caste, and other persons of mixed race,
living as members of any Native tribe. and
all Aboriginal Natives of any of the Islands
of the Pacific Ocean, shall be deemed to be
persons of the Native race .
XLII. The Short Title of this Act shall
be "The Native Circuit Courts Act, 1858."

1, A. B., do solemnly declare that I will
well and truly try all issues joined upon such
information as have been, or shall be laid or
taken before the Native Circuit Court of the
District of at this present
siting of the said Court, or at any adjourn-
ment thereof; and further that I will truly
inquire and true presentment make of all
matters to be referred to me; I will present
no man for envy, hatred, or malice, nor
spare any man far fear, favour, or affection,
or any hope of reward; but according to
the best of my knowledge and the informa-
tion I shall receive, will present the truth
and nothing but the truth.

AUCKLAND HOSPITAL.
From Letters addressed to the Surgeon or
the Colonial Hospital at Auckland by Tu paea
a nephew of Taraia's, and that the natives
are it will be seen availing themselves of
this institution in cases such as that referred
to by Tupaea, which in the absence of the
treatment received at the Hospital would
prove fatal.
We regret to observe that the Maories do
not avail themselves so much as they ought
of the Hospitals that have been established
for their benefit throughout the Country.
Many lives might have been saved if they
would bring their sick to the Hospitals in
time, before the diseases under which they
suffer become incurable. They too often
bring them when beyond the power of
medical skill, and then, should the patient
die, they are apt to complain of the Doctor
although he may have done his utmost to
effect  a cure:—
Many of our Maori readers will be sorry
to hear of the death of Dr. Rees of Whan-
ganui. He was a kind and good friend to
the Natives and paid great  attention to those

who were under his medical treatment in
the Whanganui Hospital, he died at Whan-
ganui of disease of the heart oa the 19th
September .

Salutation. My regard for you is great
because of your kindness to me, Doctor:I
salute you. Though my body is far away,
my spirt is with you. Sir, I am astonished
at the effects of your medicine upon me in
restoring me. My tribe are very grateful to
you for your cure of my tumour which you
removed, thus effecting a cure which I owe
to your skill and to the kindness both of God
and of yourself. Think not I shall forget
you. No, but I shall go to see you and, if
a fresh malady should seize me, I shall ap-
ply to you. again to treat me.

Ob the 14th July, I entered the Hospital
for the purpose of being treated for my com-
plaint . The Bishop recommended me to
the Doctor from whom I have received the
greatest kindness. I have now been two
months and a half in the Hospital and am
leaving  it on the 28th September.
Friend Doctor, salutation . My regard
for you is very great for you have been very
kind to me and have done me good. But,
friend, it is God who restores the sick by
means  of your skill and kindness, by the
kindness also of our Spiritual father,
the Roman Catholic Bishop, with our Gover-
 nor and our Queen, who care for the Pakehas
and Maories of New Zealand.
Thus ends the expression of my regard
for you.

AGRICULTURAL, COMMERCIAL, AND
MARITIME REPORT.
FROM THE IST TO THE 15TH NOVEMBER.
Our latest intelligence from Sydney is to
the 3rd instant. At that date , the grain and
flour markets were without change, nor did
there appear to be any immediate prospect
of alteration. Flour was still £22 for fine,
£20 far seconds. Bran, 2s., and wheat 8s.
6d., to 9s. but none had arrived to market
for some time previously. At Melbourne,
flour was from £19 10s. to £20 10s. At
Hobart Town it is quoted at from £18 to
£20,,—prices firm, and a good business
doing. Wheat is reported to be scarce and
fetches from 8s. to 8s. 3d. At Adelaide the
flour market is reported as being very dull;
holders offering at £14 but no buyers.
The tidings from the Fitzroy Diggings
continued to be unfavourable, the crowd
flocking back from them as wildly and as
inconsiderately  as they had previously rushed
to them. Upwards of 3000 persons are re-
ported to have got back to Sydney; and of
these a very large number had taken the un
favourable report with the same degree of
credulity with which they had received the
favourable one, and had turned their backs
upon the golden land without so much as
having set foot on its shores. There are
others, however, who are resolved to ex-
plore for themselves, and amongst several
persons there is a conviction that gold exists
and will yet be found io remunerative quan-
tity.
The arrivals since our last have been the
Lord Worsley. (another of the New Zealand
Mail Steam Ships) 500 tons, Captain John-
son, from Wellington and Napier. with sun-
dry merchandise, and 16 passengers; the
ship Harwood, 462 tons. Captain Forsyth,
from London, with a general cargo, and 90
passengers; the brig Gertrude, 118 tons,
Captain Dunning, from Sydney, with goods,
and 8 passengers; the schooner Eliezer,
56 tons, Captain Kean, from Napier, in bal-
last, 1 passenger; the ketch Pegasus, 45
tons, Captain Brier, from Napier. with 50
sheep, 10 cwt tallow, and 2 passengers;

Philip Jones, from Sydney, with a full cargo
of goods and 5 passengers; and the brig
Moa, 237 tons, Captain Bowden, with a
general cargo, and 11 passengers.
The departures were the brig Gil Blas,
175 tons, Captain Wedgwood, for Lyttelton,
with 132, 000 feet sawn timber, 2 passengers;
the ship Zealandia, 1052 tons, Captain Fos-
ter, for Guam, in ballast; the steam ship
Lord Ashley, 500 tons, Captain Stewart,
for Sydney, with 5 tons flour, 6 tuns oil, 3
cwt cheese, sundry merchandize, and 56
passengers; the  steam ship White Swan,
330 tons, Captain McLean, from the Manu-
kau. for New Plymouth, Nelson, and other
Southern ports, with sundry goods and 16
passengers; the schooner Acadian, 45 tons,
Captain Forrester, for Napier, with 2 tons
flour, 35 tons firewood, an assorted general
cargo and 4 passengers; the schooner
Salcombe Castle, 124 tons, Capt. M'Allister,
for Sydney, with 52 cwt. potatoes; the
steamship Lord Worsley. 500 tons, Captain
Johnson, for Napier, Wellington. Nelson,
New Plymouth, and Manukau, with sundry
merchandise, and 13 passengers; and the
brigantine Spray, 106 tons, Captain Ander
son, for Sydney, with 1118 bushels  wheat, 5
